Title Transfer Must Comply with Regulations
Authorities specifically pointed out that certificates of title issued independently by intermediaries or sellers hold no legal substance. According to HMRC guidelines, ownership transfers of whisky casks stored in bonded warehouses must be notified to the warehouse manager and officially updated in the register, with the industry standard being a Delivery Order. If buyers fail to obtain written confirmation from the warehouse operator, substantive legal ownership cannot be established.
Furthermore, the investigation exposed that the company long operated under fictitious names, provided unverified London registration addresses, and concealed multiple bank accounts. Even after unilaterally cutting contact with clients, the firm secretly attempted to open accounts with other bonded warehouses. Authorities emphasize that multiple whisky cask investment institutions have been wound up for similar practices in the past, urging investors to carefully verify the authenticity of ownership documents before engaging in related transactions.
